Kiefer Sutherland is having a bad 24 hours. The dashing star of the TV drama "24" was arrested for investigation of misdemeanor drunken driving early Tuesday while still on probation from a similar 2004 conviction.
Sutherland, 40, failed a field sobriety test after he was stopped for making an illegal U-turn in West Los Angeles shortly after 1 a.m., police Officer Kevin Maiberger said.
Sutherland tested over the state's legal blood alcohol limit of .08 percent, said Officer Karen Smith. However, police declined to reveal the level.
He was booked for investigation of driving under the influence of alcohol and spent about three hours in jail before he posted $25,000 bail and was released.
Maiberger said Sutherland was scheduled to appear in court Oct. 16.
"It would be premature to comment at this time," said Sutherland's publicist, Evelyn Karamanos.
Fox, which broadcasts Sutherland's show, held a party Monday night at the trendy Area nightclub, not far from where the actor was stopped, but it wasn't immediately known if he had attended. The event was a celebration of the network's new fall shows.
The city attorney's office had not received the police report and had not filed charges Tuesday afternoon.
A misdemeanor DUI count would carry a maximum sentence of a year in jail. However, Sutherland also could face a charge of violating probation -- the same charge that landed socialite Paris Hilton in jail for 23 days.
In November 2004, Sutherland pleaded no contest to one misdemeanor count of driving under the influence and was sentenced to 60 months of probation, 50 hours of community service and was ordered to attend an alcohol treatment program, said Frank Mateljan, a spokesman for the city attorney's office.
In May 2005, Sutherland provided the court with proof that he had completed the community service and the treatment, Mateljan said.
Mateljan said Sutherland also had a 1993 conviction for alcohol-related reckless driving. He had no additional details on either case.
Sutherland won a best actor Emmy award last year for his performance as dashing federal counter-terrorist agent Jack Bauer on the Fox TV series "24." The series is set to return to the air in January.
In the wake of his latest arrest, a nonprofit group that raises money for Los Angeles police causes said it would no longer use Sutherland to present its guest of honor at an upcoming fundraiser.
Sutherland was supposed to introduce his friend, producer Brian Grazer, at the "True Blue" fundraiser of the Los Angeles Police Foundation that is scheduled for Saturday. Instead, actor Ron Howard will introduce Grazer at the $350-a-plate event at Paramount Studios, foundation President Karen Wagener said.
"Obviously we don't want to embarrass him ... or the department, so introducing Brian on the stage would be inappropriate," she said.
Sutherland still was on the invitation list for the affair, which was expected to raise $1 million. However, Wagener said she had not contacted the actor and it was not immediately clear whether he would attend.
Sutherland, who was born in London but went to high school in Canada, was receiving an award of excellence Tuesday afternoon from the Alliance of Canadian Cinema, Television and Radio Artists. After his arrest the event at the official residence of the Canadian consul general was closed to the media.
"We are honoring Mr. Sutherland's commitment to Canada and to Canadian performers," Richard Hardacre, ACTRA national president, said in a statement

Kiefer Sutherland passe un mauvais 24 heures. La splendide étoile de la série "24" a été arrêtée mardin matin pour conduite avec facultés affaiblies, alors qu'il était sous probation suite à une accusation similaire en 2004.
Sutherland, 40 ans, a échoué un test d'alcoolémie après avoir été arrêté pour un virage interdit dans Los Angeles ouest, peu après 1 a.m., rapporte l'officier de police Kevin Maiberger.
Le taux d'alcool sanguin de Sutherland dépassait la limite de .08 pour cent tolérée par l'état, dit l'officier Karen Smith. Les autorités policières ont toutefois refusé de divulguer son indice d'alcool.
Il a été mis sous enquête pour conduite sous influence de l'acool et a passé environ 3 heures en prison avant de payer la caution de 25 000$ et d'être relâché.
Maiberger dit que Sutherland devrait paraître en cour le 16 octobre.
"Il serait prématuré de commenter à ce moment-ci" a déclaré Evelyn Karamanos, publiciste de Sutherland.
La FOX, qui diffuse l'émission de Sutherland, a tenu une fête lundi soir au populaire club Area, non loin de l'endroit où Sutherland a été arrêté, mais sa présence n'a pas été immédiatement confirmée. La soirée se voulait une célébration en l'honneur des nouvelles émissions de l'automne.
Mardi après-midi, le bureau du procureur de la ville n'avait pas reçu le rapport des policiers et n'avait pas logé de plainte.
Une infraction de conduite en état d'ébriété pourrait se voir imposer une sentence allant jusqu'à un maximum d'un an en prison. Toutefois, Sutherland pourrait aussi être incriminé de bris de probation --la même incrimination qui a valu 23 jours de prison à Paris Hilton.
En novembre 2004, Sutherland ne s'est pas ooposé au verdict de conduite en état d'ébriété et a reçu 60 mois de probation, 50 heures de travaux communautaires et on lui a ordonné de suivre un programme de réhabilitation quant à l'alcool, dit Frank Mateljan, porte-parole du procureur.
En mai 2005, Sutherland a prouvé à la cour qu'il avait complété les travaux communautaires et le programme, selon Mateljan.
Mateljan rapporte que Sutherland a aussi été accusé de conduite dangereuse avec facultés affaiblies en 1993. Il n'avait pas plus de détails.
Sutherland a été récipiendaire l'an dernier d'un Emmy pour son inteprétation de l'époustoufflant agent fédéral Jack Bauer, chasseur de terroristes dans la série "24" sur la chaîne FOX. La série devrait revenir en ondes en janvier.
Suite à sa récente arrestation, un groupe à but non lucratif qui amasse des fonds pour la police de Los Angeles a décidé que Sutherland ne présenterait plus leur invité d'honneur lors du prochain gala bénéfice.
Sutherland devait présenter son ami, le producteur Brian Gazer, à la soirée bénéfice "True Blue", qui amassera des fonds pour le département de police de Los Angeles, samedi. À sa place, l'acteur Ron Howard présentera Gazer à cette soirée à 300$ le couvert, tenue aux studios Paramount, a dit Karen Wagener, présidente de la fondation.

According to the two charges against Kiefer Sutherland, there could possibly be a case of DOUBLE JEOPARDY. There is such a thing and it does exist for DUI cases, according to the California DUI Laws.
This could truly be an unfair advantage that the California Court may consider. However, although Kiefer has two charges pending, the court cannot convict him on both. Taken from the files of the California Laws and the Drunk Driving Law Guide for attorneys, a case was cited, which pretty much corresponds with this situation.
Thus far, Kiefer is facing two allegations. One is the Driving Under the Influence, and the other is DUI with a BAC level of 0.08 or above, both misdemeanors. This would be considered ‘double jeopardy charges.’
IF I were Kiefer’s attorney, I would certainly look at all avenues, because no matter what, he can be ‘charged with two,’ but he can only be convicted on ONE. The judge will have to choose ‘which one.’
Although I’m certain that the majority of Kiefer’s fans as well as everyone at FOX is hoping for the best, by reviewing the DUI Third Conviction laws, which are repeated below the case citing, some of us will be assisting with ‘positive thoughts’ and some of us ‘prayers’ (or both) that the judge will consider his position and honoring his contracts with FOX. Although...lets see now…how many DUI’s did Paris have? And, umm, wasn’t SHE DRIVING WITHOUT A LICENSE…and didn’t she get something like twenty-nine days?, or some foolish figure like that? Well…this outcome should be interesting!

The following is from a California case, People v. Cosko, 152 Cal. App. 3d 54, 199 Cal. Rptr. 289 (1984).
This case argues the question of whether the defendant could be convicted twice under separate subdivisions of the California Vehicle Code. The driver's defense was presented as follows:
“Appellant contends that he was improperly convicted of two counts of driving under the influence, one for violating Vehicle Code section 23153, subdivision (a), and another for violating subdivision (b) of the same section based on one incident. We conclude that the Legislature added the 0.10 percent blood alcohol offense subdivision (subd. b) to facilitate proof of driving under the influence and that it did not intend a single driving under the influence incident to result in two driving under the influence convictions under Vehicle Code section 23153.
We are not concerned with the question of double charging, which is within the prosecutor's discretion, or with double punishment, which is clearly prohibited by Penal Code section 654. The question of double conviction, however, requires analysis of the legislative intent behind the addition of the 0.10 percent subdivision. [Id. at 290.]
The court concluded that the legislature did not intend that routine driving under the influence convictions would result in two convictions. The court based this opinion on an examination of the legislative history and the sentencing scheme of the statute. The court therefore held:
The general rule in the case of an improper combination of convictions is that the less serious offense is vacated while the more serious stands. (E.g., People v. Cole, supra, 31 Cal. 3d at p.582.) Since neither the under the influence offense nor the 0.10 percent offense is more serious than the other, the determination which conviction should stand is a discretionary matter. [Id. at 291-292.]
The Cosko decision was subsequently ordered by the California court not to be published. However, a later case was published. In People v. Duarte, 161 Cal. App. 3d 438 (1984), a California appellate court held that a defendant may be convicted under both statutes. However, he may only be punished for one; the judge must choose which one. Technically, punishment for the second conviction is temporarily stayed until after completion of sentence on the first — at which time the stay is made permanent. In addition, only one of the convictions may be used as a prior conviction for purposes of enhanced punishment on future DUI convictions.”
California Vehicle Code §23546
Conviction of Third Violation of §23152; Punishment:
a.If any person is convicted of a violation of Section 23152 and the offense occurred within ten years of two separate violations of Section 23103, as specified in Section 23103.5, 23152, or 23153, or any combination thereof, which resulted in convictions, that person shall be punished by imprisonment in the county jail for not less than 120 days nor more than one year and by a fine of not less than three hundred ninety dollars ($390) nor more than one thousand dollars ($1,000). The person's privilege to operate a motor vehicle shall be revoked by the Department of Motor Vehicles as required in paragraph (5) of subdivision (a) of Section 13352. The court shall require the person to surrender his or her driver's license to the court in accordance with Section 13550.
b.Any person convicted of a violation of Section 23152 punishable under this section shall be designated as a habitual traffic offender for a period of three years, subsequent to the conviction. The person shall be advised of this designation pursuant to subdivision (b) of Section 13350.
California Vehicle Code §23548
Conditions of Probation for Third Time Offense
a.If the court grants probation to any person punished under Section 23546, in addition to the provisions of Section 23600 and any other terms and conditions imposed by the court, the court shall impose as conditions of probation that the person be confined in the county jail for at least 120 days but not more than one year and pay a fine of at least three hundred ninety dollars ($390) but not more than one thousand dollars ($1,000). The person's privilege to operate a motor vehicle shall be revoked by the Department of Motor Vehicles pursuant to paragraph (5) of subdivision (a) of Section 13352. The court shall require the person to surrender the driver's license to the court in accordance with Section 13550.
b.In addition to subdivision (a), if the court grants probation to any person punished under Section 23546, the court may order as a condition of probation that the person participate, for at least 30 months subsequent to the underlying conviction and in a manner satisfactory to the court, in a driving-under-the-influence program licensed pursuant to Section 11836 of the Health and Safety Code. In lieu of the minimum term of imprisonment specified in subdivision (a), the court shall impose as a condition of probation under this subdivision that the person be confined in the county jail for at least 30 days but not more than one year. The court shall not order the treatment prescribed by this subdivision unless the person makes a specific request and shows good cause for the order, whether or not the person has previously completed a treatment program pursuant to paragraph (4) of subdivision (b) of Section 23542 or paragraph (4) of subdivision (b) of Section 23562. A person ordered to treatment pursuant to this subdivision shall apply to the court or to a board of review, as designated by the court, at the conclusion of the program to obtain the court's order of satisfaction. Only upon the granting of that order of satisfaction by the court may the program issue its certificate of successful completion and report the completion to the Department of Motor Vehicles. A failure to obtain an order of satisfaction at the conclusion of the driving-under-the-influence program is a violation of probation. In order to enable all required persons to participate, each person shall pay the program costs commensurate with the person's ability to pay as determined pursuant to Section 11837.4 of the Health and Safety Code. No condition of probation required pursuant to this subdivision is a basis for reducing any other probation requirement in this section or Section 23600 or for avoiding the mandatory license revocation provisions of paragraph (5) of subdivision (a) of Section 13352.
c.In addition to the provisions of Section 23600 and subdivision (a), if the court grants probation to any person punished under Section 23546 who has not previously completed a treatment program pursuant to paragraph (4) of subdivision (b) of Section 23542 or paragraph (4) of subdivision (b) of Section 23562, and unless the person is ordered to participate in and complete a driving-under-the-influence program under subdivision (b), the court shall impose as a condition of probation that the person, subsequent to the date of the current violation, enroll and participate, for at least 18 months and in a manner satisfactory to the court, in a driving-under-the-influence program licensed pursuant to Section 11836 of the Health and Safety Code, as designated by the court. The person shall complete the entire program subsequent to, and shall not be given any credit for program activities completed prior to, the date of the current violation. Any person who has previously completed a 12-month or 18-month program licensed pursuant to Section 11836 of the Health and Safety Code shall not be eligible for referral pursuant to this subdivision unless a 30-month licensed driving-under-the-influence program is not available for referral in the county of the person's residence or employment. The program shall provide for persons who cannot afford the program fee pursuant to paragraph (2) of subdivision (b) of Section 11837.4 of the Health and Safety Code in order to enable those persons to participate. No condition of probation required pursuant to this subdivision is a basis for reducing any other probation requirement in this section or Section 23600 or for avoiding the mandatory license revocation provisions of paragraph (5) of subdivision (a) of Section 13352.
§7.1 Determine Whether Multiple Convictions Were Permissible
When one offense is necessarily included within another, only one conviction is allowed. See People v Greer (1947) 30 C2d 589, 597-598, and cases cited. The court should instruct the jury with CALJIC l7.03 when one offense is a necessary lesser included of another. If there were two convictions, the court will have to dismiss the lesser at the sentencing hearing.
